These terms govern your use of the Marstech Solution website and form the general basis on which we provide our services. Specific projects are also governed by a separate proposal, statement of work or service agreement, which takes precedence if there is any conflict.
Use of the Website
You may use this website for lawful purposes only. You must not attempt to gain unauthorised access to the site, interfere with its operation or use its content in a way that infringes our rights or the rights of others.
Services
We provide software development, integration, consulting, hosting and support services as described in the proposal or agreement for each project. Timelines and deliverables depend on timely information, feedback and approvals from the client and, where relevant, on third-party suppliers.
Third-Party Suppliers
Many of our solutions connect to third-party systems such as GDSs, airlines, hotel suppliers and payment gateways. Access to these systems is subject to the client's own agreements with those providers. We are not responsible for their availability, pricing, content or changes to their APIs, although we will help you adapt to such changes under our support terms.
Fees and Payment
Fees, payment milestones and taxes are set out in each proposal or agreement. Unless agreed otherwise, invoices are payable within the period stated on the invoice. We may pause work if payments are overdue.
Intellectual Property
Content on this website, including text, graphics and logos, belongs to Marstech Solution or its licensors. Ownership of software delivered to clients is defined in the relevant agreement. For custom development projects, ownership of the custom source code transfers to the client on full payment, while our pre-existing tools and libraries remain our property and are licensed for use within the delivered solution.
Confidentiality
Both parties agree to keep confidential any non-public business, technical or commercial information received from the other, and to use it only for the purpose of the project.
Limitation of Liability
To the extent permitted by law, we are not liable for indirect or consequential losses, including loss of profit, revenue or data. Our total liability for any claim relating to a project is limited to the fees paid for that project in the twelve months before the claim, unless the relevant agreement states otherwise.
Governing Law
These terms are governed by the laws of India, and the courts of New Delhi have jurisdiction, unless a project agreement specifies otherwise.
Changes to These Terms
We may update these terms from time to time. The latest version will always be available on this page.
